Welcome to MyTourMate. These Terms of Service ("Terms") govern your access to and use of the MyTourMate mobile application, website, and any other related services (collectively, the "Platform" or "Services"). By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, please do not use the Services.

1. Our Role

MyTourMate is a platform that connects travelers with local individuals (“Guides” or “Mates”) who offer tour guidance and companionship experiences. MyTourMate does not employ, supervise, or directly manage these Guides. Each Guide operates as an independent contractor and is solely responsible for the services they offer and provide.

MyTourMate is not liable for any acts, omissions, negligence, misrepresentations, or misconduct by any Guide or Traveler.

2. Eligibility

You must be at least 18 years of age and legally capable of entering into binding contracts to use this Platform. By registering or using the Services, you confirm that you meet this requirement.

3. Account Creation

To use our Services, you must create an account and provide accurate and complete information. You are solely responsible for maintaining the confidentiality of your account and password.

You are responsible for all activities that occur under your account, and you agree to notify us immediately of any unauthorized use.

4. Booking & Payments

All bookings must be made through the MyTourMate app or website. MyTourMate acts as a payment processor only and does not assume responsibility for any services beyond facilitating the transaction.

All prices, fees, and terms are shown prior to booking. Payments are non-refundable except as outlined in our Refund Policy.

5. Code of Conduct

By using our Services, you agree:

• To treat all users respectfully and professionally.

• Not to harass, abuse, threaten, or discriminate against any individual.

• Not to request or offer illegal activities, including but not limited to sexual services, drugs, or violence.

• Not to use the platform to violate local laws, customs, or public morality.

We reserve the right to ban, suspend, or permanently delete accounts for any violations.

6. Disclaimer of Liability

MyTourMate does not guarantee the safety, legality, quality, or accuracy of any tour, experience, or Guide.

By booking a tour, you understand and accept that:

• You are solely responsible for your personal safety, health, and belongings during a tour.

• MyTourMate is not responsible for injury, death, theft, property damage, or other harm resulting from interactions or activities arranged via the platform.

• You agree to release and indemnify MyTourMate and its operators from any and all claims, liabilities, losses, or damages.

  
  

7. Cancellations and Refunds

Please refer to our Refund & Cancellation Policy for details on eligibility and processing of refunds.

8. Termination of Access

We may terminate or suspend your access at our sole discretion, with or without notice, for behavior we determine harmful, illegal, or otherwise in violation of these Terms.

9. Changes to the Terms

We may update these Terms from time to time. Continued use of the platform after updates implies your acceptance of the new terms.

10. Governing Law

These Terms shall be governed by the laws of the jurisdiction in which MyTourMate is registered and operated. Disputes will be resolved through arbitration or courts of competent jurisdiction.
